This document contains the General Terms and Conditions of Use (hereinafter "General Terms and Conditions") of the site www.tigem.it, which is the main site, and of the third level Internet sites (hereinafter, for brevity, jointly, the "Site") to which anyone intending to navigate on their pages must adhere. Access to the Site and any action involving navigation on its pages constitute acceptance of the General Conditions. In the event that the user does not intend to accept the General Conditions, it is sufficient for him/her to refrain from navigating on the pages of the Site. Anyone accessing the Site implicitly declares that he/she will not use the Site and the material it contains for illegal purposes or in any case contrary to the laws in force. General Conditions can be modified by Fondazione Telethon (hereinafter "Telethon") to which TIGEM belongs at all times, without giving any notice to users and without prejudice to users' obligation to periodically read them before accessing the Site contents. Access to the Site after such changes implies full and unconditional adhesion to the General Conditions as modified. In the event that additional services are offered within the web pages of the Site or content is presented that is subject to specific terms and conditions contained in those pages, the same shall prevail over these General Conditions.

 

The Site is maintained for informative purposes only, outside any professional relationship with the user and the navigator. The main site and the third level sites allow users to be informed about the main activities carried out at TIGEM, about its structure, scientific publications, facilities and scientific research activities conducted there. All the contents of the site (news, photos, videos, sounds, trademarks, logos, domain names, software applications, graphic layouts, technical documentation and manuals, etc.) and the rights related to them are reserved, therefore they can be consulted only for personal information purposes, being expressly forbidden any other use without the prior written consent of Telethon.

 

The Site may contain links to third parties' sites (public administrations, collaborating companies, etc...) with which TIGEM has some relation. Hyperlinks have the sole function of facilitating the user's navigation and the possibility to deepen certain information. Moreover, Telethon informs that it cannot influence in any way the structure of the third institutional sites linked to its own, nor can it have knowledge of the truthfulness, correctness and adequacy of the materials and/or information contained in them. In the event that specific conditions of use are present on the site reached, the latter must be considered as prevailing over the General Conditions. For this reason, the owner of the Site declines all responsibility for the content of the sites connected by links, or in any other form, for their failure to be updated or for any other damage that may occur to the user as a result of navigating on them. Owners of linked sites who do not wish to be referred to may indicate this and they will be removed immediately.

 

All the contents of the Site are protected and safeguarded by current copyright and intellectual property laws. Any extraction or reuse of the material on the Site that is not expressly authorised is prohibited, as is any other activity that may damage the legitimate interests of the authors and owners of the rights to the intellectual works accessible on the Site. The Site and its contents may be used exclusively for personal, research or teaching purposes, with the exclusion of any directly or indirectly commercial purpose, provided that the details of the right holder are left intact and no changes are made to them. It is therefore not possible to copy and/or reproduce in whole or in part the content of the Site without the express authorisation of Telethon. At the same time, please note that all trademarks, domain names, company names, companies and signs present on the Site are the exclusive property of Telethon and therefore protected by the current legislation on distinctive signs. It is therefore absolutely forbidden to reproduce them in any form or way without the express authorization of Telethon, as well as it is to be considered forbidden to register the trademark "Telethon" or "TIGEM" in any top-level domain. Please note that in the pages of the Site there could be trademarks, domain names, company names, companies and signs owned by third parties, with which Telethon has a partnership relationship, which enjoy the same protection granted to the distinctive signs of Telethon by the regulations in force. Telethon informs that it is absolutely forbidden to use all the distinctive signs owned by Telethon as metatags, and/or every html language command that, even if not implying the display or the formatting of a certain command, provide in any case instructions to electronic agents or to search engines to increase the searchability of a site different from those traceable to Telethon.

 

Telethon informs that the content of the Site cannot be, in whole or in part, copied, reproduced, republished, uploaded, transcribed, transmitted or distributed, in any way or form, without having obtained the prior written authorization of Telethon, except for the activities of printing, downloading and displaying part of the Site's content carried out for exclusively personal and non-commercial purposes and provided that the material in question is not modified in any way and that all the information relating to intellectual property rights therein is preserved. Moreover, the content of the Site may not be disseminated, in whole or in part, through communication channels, such as the Internet (also through web platforms or similar), television, radio or any other kind of systems without the prior written consent of Telethon. The information and the materials contained in the Site cannot be used for commercial purposes in order to create databases of any kind, nor can they be filed (in whole or in part) in pre-existing databases, either accessible exclusively by the creator or made available to third parties. With reference to the embeddable videos present on the site www.tigem.it, it should be noted that they - where authorised - have been uploaded through the YouTube channel, and therefore for their regulation please refer to the conditions governed by the site www.youtube.it.

 

Without the written authorization of Telethon, it is in no way allowed to create links to the home page of the Site currently reachable at the web address https://www.tigem.it/ (hereinafter also the "Home Page") or to any other page within the Site. If, however, there is an interest in creating a link to the Home Page on one's own site, a request to this effect must be sent by e-mail to info@telethon.it in which the following must be indicated:

(a) the data of the natural/legal person making the request

(b) the explicit reasons for the request

(c) the data relating to the person responsible for the technical aspects of site management where the link to the Home Page is to be inserted (including e-mail address and telephone number);

(d) an indication of the web address of the site where the link will be created;

(e) any further information deemed useful in order to obtain the authorization from Telethon.

“Framing" links are forbidden; these links enable the appearance of a page of the site in a specific page of another external site, so that the content of that page, instead of appearing in a separate browser window, appears in a frame structured for that purpose.

Telethon informs that - due to the nature of the financed scientific research - all the contents published on the Site are provided only for general information purposes and may not be complete and exhaustive and therefore Telethon reserves the right to modify and update such information without any notice.

 

Navigation on the Site is completely FREE and all information and relations exchanged between the owner of the site and the surfers are non-profit and outside any commercial or professional activity.

 

The content of the Site is protected by copyright and may be freely printed and used only for personal and non-commercial use.

 

The user acknowledges that navigation on the Site is at his/her sole risk. Neither the owner of the Site nor any other person who has collaborated in the creation, production or uploading of the Site shall be liable for any damage resulting from browsing, including downloading, use of downloaded materials, transmission problems, errors, omissions, inaccuracies of any kind, interruptions or delays, viruses or other.

 

Should any clause of these General Conditions be deemed illegal, void, or for any reason ineffective, that clause will be deemed severable from the other clauses, without affecting the validity and effectiveness of the remaining provisions.

 

Without prejudice to any rights that users may have under different national or international laws, these General Conditions shall be subject to Italian law and shall be interpreted in accordance with the same (with the exception of its rules on conflicts of law), including any dispute concerning the existence, validity and effectiveness of the General Conditions and any other agreement that refers to them. Within the limits of the above, the Court of Rome shall have jurisdiction to hear any dispute arising in connection with these General Conditions as well as any other agreement that refers to them. By virtue of the application of Italian law, in the event of any conflict of interpretation between the Italian language version and the English language version of these General Conditions of Use, the Italian version shall prevail.
